Cartoon Porn
I'm sure we've all seen the hysterical drawings/gif clips of animated porn containing characters from famous cartoons. It's not difficult to stumble onto porno-fied versions of The Jetsons or The Simpsons, but my question is, are there any laws that govern this? What about as far as hentai/anime is concerned? i.e., Is it legal to characterize a living person into a drawing/animation and place that person into a sexual act?

Re: Cartoon Porn
I think the Burroughs estate did sue to keep SHAME OF THE JUNGLE out of theaters in the 1970s.

Re: Cartoon Porn
Of course, Disney and Warner Brothers have had their issues in the past, do these laws still exist today?

Re: Cartoon Porn
In the 1970's, there were several XXX theatrical cartoons. Dave Friedman even produced one of them called Sex in the Comics, which played at Pussycat theaters. (I also recall another one called The Erotic Cartoon Festival, which was a collection of XXX cartoon shorts.)

Re: Cartoon Porn
"Sex in the Comics" was live action (Actors with weird make up to make them look like famous cartoon characters) and inadvertantly creepy as HELL.

Re: Cartoon Porn
I remember seeing a VHS box for "Sex in the Comics" at a video store in St. Louis, Mo. The picture of the actors on the box in cartoon costumes was just too bizarre to rent.

Re: Cartoon Porn
It could possibly fall under "parody" (the way Weird Al can get away with using other people's songs, The Onion can use real people, companies, and products in their paper, etc). I would guess Disney, The Simpsons, etc, would probably not go after someone using their © images in porno cartoons, as it would just attract more attention to them. Only in Japan will XXX cartoons of famous cartoons ever me a multi million dollar business
(and therefore worthwhile for the © holder to go after the offenders). |

From Wikipedia: The Supreme Court of the United States decided in 2002, and affirmed in 2004, that previous prohibition of simulated child pornography under the Child Pornography Prevention Act of 1996 was unconstitutional.[21] The majority ruling stated that "the CPPA prohibits speech that records no crime and creates no victims by its production. Virtual child pornography is not 'intrinsically related' to the sexual abuse of children." On 30 April 2003, President George W. Bush signed into law the PROTECT Act of 2003 (also dubbed the Amber Alert Law) which again criminalizes cartoon child pornography.[22] The Act introduced 18 U.S.C. 1466A which criminalizes both Miller Test obscene cartoon depictions of a minor engaging in sexually explicit conduct, and, as noted by the 11th Circuit in United States v. Williams, cartoon depictions of a minor or what appears to be a minor engaging in overt sexual intercourse (not merely sexually explicit) and need satisify only the third part of the Miller Test, that it lack serious artistic value.[23] In December 2005, Dwight Whorley was convicted[24] under 18 U.S.C. 1466A(a)(1) on twenty counts for receiving "...obscene Japanese anime cartoons that graphically depicted prepubescent female children being forced to engage in genital-genital and oral-genital intercourse with adult males."[25] |

I wish the quote read: In December 2005, Dwight Whorley was convicted[24] under 18 U.S.C. 1466A(a)(1) on twenty counts for receiving "...obscene Japanese anime cartoons that graphically depicted prepubescent female androids with EE cup breasts being forced to engage in genital-genital, oral-genital, intestine-genital, amputated arm stump-genital, tentacle-genital and bat wing-genital intercourse with adult interdementional demonoid shapeshifters." |
